Lief Parke LLP Notches a Win in State Court

Sometimes an IP client’s needs extend beyond IP. One such client asked for our help in addressing their local Planning Board’s actions disregarding the client’s rights in favor of a developer looking to build on the adjacent property. Lief Parke brought an Article 78 proceeding in the New York State Supreme Court challenging the Board’s approval. The Court found that the Planning Board had not followed its own Town Code in the important area of freshwater wetlands concerns. Accordingly, the Court annulled the approval, which halted the injurious activities from moving forward and preserved the client’s property rights and value.
